DriversTeams Terms of Service

Thank you for using DriversTeams!

These Terms of Service (“Terms”) are a binding legal agreement between you and DriversTeams that govern your use of the websites, applications, and other services from DriversTeams (collectively, the “DriversTeams Platform”). When used in these Terms, “DriversTeams”, “we”, “us”, or “our” refers to one of the DriversTeams companies (entities) with whom you are contracting (see clause 25 of these Terms). If you are entering into these Terms on behalf of an entity, such as your employer or the company you work for, you affirm that you have the legal authority to bind that entity (in this case, DriversTeams has the right to ask for proof of authorisation).

The DriversTeams Platform offers an online venue that enables users (“Members”, „you“ - which may also be used in the context of the specific clause referring to either one or both Members) to publish, offer, search for employees or employers, and book services. Members who publish works are “Employer” Members who search for work are “Employees”. You must register an account to access and use many DriversTeams Platform features and keep your account information accurate.

As the provider of the DriversTeams Platform, DriversTeams does not own, control, offer or manage any Services or Listings. DriversTeams is an online platform (intermediary). Therefore, DriversTeams is not a party to the contracts concluded directly between Employer and Employees. DriversTeams is not acting as an agent in any capacity for any Member.

We maintain other terms and policies that supplement these Terms, like our Privacy Policy, which describes our collection and use of personal data.

If you are the Employer, you are responsible for understanding and complying with all laws, rules, regulations, and contracts with third parties that apply to your suggestions.

PLEASE READ THESE TERMS CAREFULLY. BY REGISTERING FOR, ACCESSING, BROWSING, AND/OR OTHERWISE USING THE DREAVERSTEAMS SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, DO NOT ACCESS, BROWSE OR OTHERWISE USE THE DREAVERSTEAMS PLATFORM OR THE DREAVERSTEAMS SERVICES.

I. Employees Terms  

1. Our mission 

Our mission is to simplify work search. If you have questions, just message the Employer.

2. Searching and Employers, Employees on DriversTeams  

  1. Searching. You can search using various criteria. You can also use filters to refine your search results. Search results are based on their relevance to your search and other criteria. Relevance considers factors like price, availability, reviews, popularity, and more. Certain Employer may be displayed above others due to their chosen subscription plan. Therefore, please pay close attention to this, because your personal factors and expectations must always be considered when evaluating search results. DriversTeams is not responsible for the personalized accuracy and specific expectations of search results. If you are looking for something specific or can't find the results you are looking for, don't hesitate to get in touch with us directly, and we will try to help you.

  2. DriversTeams help. DriversTeams may help you contact your Employer. However, DriversTeams cannot guarantee that the Employer will respond to your messages or meet your demands.

  3. DriversTeams Fees for Employees. DriversTeams does not apply any charges for the Employees and will never increase the cost of Services or apply any other hidden fees. DriversTeams’s primary revenue source are subscription payments and other payments paid to DriversTeams directly by Employer for the use of platform.

3. Cancellations, Refunds.

  1. DriversTeams does not, under any circumstances, require or retain any part of the advance payment. The Employer directly with the Employees shall agree upon advance payment collection, repayment and other conditions. In all cases, the Employer assumes all liability to duly inform the Employees of the conditions for the collection of advance payments. DriversTeams is not responsible for refunding advance payments, and no claim or demand for repayment may be made against DriversTeams.

4. Your Responsibilities and Assumption of Risk.

  1. Your Responsibilities. You are responsible and liable for your actions and omissions, as well as being responsible for the acts and omissions of anyone you give access to your DriversTeams account.

  2. Your Assumption of Risk. DriversTeams is an online platform (intermediary) and is not a party to the service agreements concluded directly between Members. Therefore, the Employer is legally obliged (if applicable) to inform Employees directly of all the laws and rights applicable in the country of Employer, including but not limited to consumer rights and other regulations and limitations. If the Employer fails to properly exercise its obligation to inform Employees of his/her rights, DriversTeams shall not be subject to any claims, demands, or other consequences. You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the entire risk arising out of your access to and use of the DriversTeams Platform and any Content (as defined in Section 10), including use of any other Service, or any other interaction you have with other Members whether in person or online. Therefore, it is your responsibility to investigate a Service to determine whether it suits you. If Employer does not have sufficient information to decide whether the Employees is suitable for him/her, or if Eemployer has any questions, Employer should ask the Employees or DriversTeams for additional information.

II. Employer Terms

  1. DriversTeams reserves the right to delete or block certain Listings that do not meet statutory requirements for online B2C (business to customer) provision.

  2. Know Your Legal Obligations. You are responsible for understanding and complying with these Terms and any additional terms of DriversTeams, laws, rules, regulations, and contracts with third parties that apply to your Services.

  3. Search Ranking. The ranking of Listings in search results on the DriversTeams Platform depends on a variety of factors, including these main parameters:

    1. Employers search parameters,

    2. Listing characteristics,

    3. Employers experience,

    4. Employers requirements,

    5. Employers preferences,

    6. Your Listing popularity, and

Search results may appear different on the DriversTeams mobile application than they appear on our website. DriversTeams may allow Employees to promote their Listings in search or elsewhere on the DriversTeams Platform, subject to their subscription plans or by paying an additional fee. DriversTeams does not guarantee the accuracy of searches and personal expectations.

8. Fees for Employers. 

  1. Subscription Plans. The use of the DriversTeams Platform for the Employers is subject to a fee. Different rates apply to different subscription plans. The applicable fee is charged in advance on monthly or annual payment intervals, unless agreed otherwise between parties. All fees are non-refundable, i.e. there are no refunds or credits for periods where the Employers did not use an activated account, used it only partially, deactivated the account, or terminated these Terms during an ongoing payment interval. If, after signing up, a Employers elects to upgrade to a more expensive subscription plan, the unused portion of any prepaid fees shall be applied to the fee of the more expensive subscription plan.

  2. Free Trial. A new Employers may be entitled to a free trial. The Employers is not required to provide any credit card information during the free trial period. If the free trial period has expired, the Account will be automatically deactivated. To prevent deactivation or reactivate the Account, the Employers must select a suitable subscription plan and pay the first fee. If the Employers does not pay the first fee within two weeks of the free trial expiration date, DriversTeams has the right to delete the Account permanently.

  3. Discounts and Special Offers. In addition to the current collection of subscription plans, DriversTeams may but is not obliged to offer special discounts and motivation schemes..

9. Taxes.

  1. Employers Taxes. As a Employers, you are responsible for determining and fulfilling your obligations under applicable laws to report, collect, remit, or include in your price any applicable or other indirect taxes (“Taxes”).

  2. Tax Information. In certain jurisdictions, Tax regulations may require that we collect and/or report personal Tax information, and/or withhold payout Taxes. If you fail to provide us with documentation that we determine to be sufficient to support any such obligation to withhold payout Taxes, we may withhold payouts up to the amount required by law until sufficient documentation is provided. You agree that DriversTeams may issue invoices or similar documentation for VAT, GST, consumption, or other Taxes for your Services to facilitate accurate tax reporting by you, your organization and/or our Employers.


III. General Terms.

10. Reviews. 

  1. Employers and Employees have the opportunity to review each other. Your review must be accurate and may not contain any discriminatory, offensive, defamatory, or other offensive and inappropriate language. If a review submitted to the DriversTeams Platform by any Member is offensive, defamatory or violates any law, DriversTeams shall have the right to remove it.

  2. DriversTeams does not modify, edit, or otherwise alter the reviews published on the DriversTeams Platform. DriversTeams itself never provides reviews on any Members.

  3. A review by a Member who has concluded a service agreement and made a payment for services via DriversTeams Platform is marked as "verified".

  4. DriversTeams has the right but no obligation to inquire Members for additional information about the review they have left to verify the information or its validity.

11. Content.

  1. Parts of the DriversTeams Platform enable you to provide feedback, text, photos, audio, video, information, and other content (collectively, “Content”). By providing Content in any form and through any means, you grant DriversTeams a non-exclusive, worldwide, royalty-free, irrevocable, perpetual, sub-licensable and transferable license to copy, modify, prepare derivative works of, distribute, publish and otherwise exploit that Content, without limitation. You are solely responsible for all Content you provide and warrant that you either own it or are authorized to grant DriversTeams the rights described in these Terms.

  2. You are responsible and liable if any of your Content violates or infringes any third party's intellectual property or privacy rights. DriversTeams prohibits, among other things, discriminatory, obscene, harassing, deceptive, violent, and illegal Content. If such Content is detected, DriversTeams has the right to make such unauthorized Content invisible or remove it temporarily. When DriversTeams removes or disables Content, the responsible Member will be notified, and DriversTeams will provide the reasons for such a measure unless such notification would (i) prevent or impede the detection or prevention of fraud or other illegal activities, (ii) harm the legitimate interests of other Members or third parties, or (iii) contravene applicable laws. One may appeal such a decision by contacting DriversTeams’s customer service. If you disagree with DriversTeams's decision to remove certain Content, you have the right to appeal the decision to remove Content directly to DriversTeams or other dispute resolution authorities.

  3. Agreeing to these Terms permits DriversTeams to make available services or automated tools to translate Content and to translate Content using such services or tools. However, DriversTeams does not guarantee the accuracy or quality of translations. Members are responsible for confirming the accuracy of such translations or informing DriversTeams if you notice a discrepancy.

  4. DriversTeams never modifies the Content uploaded by the Employers, except when the Content is altered due to technical manipulations (e.g. translation, colour and picture quality changes). In all cases, the Employers is responsible for the Content and the accuracy of the information contained therein.

12. Fees and Payment Collection. 

  1. DriversTeams reserves the right to change the service fees at any time and will notify Members of any fee changes before they become effective. If you disagree with a fee change, you may terminate this agreement at any time under these Terms.

  2. For payment collection, DriversTeams uses third-party payment Employers in the United States – PayPal Inc., in the European Union – UAB PaySera). Members undertake to accept and abide by the terms and conditions of use of third-party payment Employers. The Employers is responsible for paying these payment collection fees.

13. DriversTeams Platform Rules. 

  1. Rules. These rules must be followed, and DriversTeams Members are prohibited from helping or inducing others to break or circumvent these rules:

    1. Act with integrity and treat others with respect:

      1. Do not lie, misrepresent something or someone, or pretend to be someone else.

      2. Be polite and respectful when you communicate or interact with others..

      3. Do not discriminate against or harass others.
    2. Do not scrape, hack, reverse engineer, compromise or impair the DriversTeams Platform:

      1. Do not use bots, crawlers, scrapers, or other automated means to access or collect data or other content from or otherwise interact with the DriversTeams Platform.

      2. Do not hack, avoid, remove, impair, or otherwise attempt to circumvent any security or technological measure used to protect the DriversTeams Platform or Content.

      3. Do not decipher, decompile, disassemble, or reverse engineer any of the software or hardware used to provide the DriversTeams Platform.

      4. Do not take any action that could damage or adversely affect the performance or proper functioning of the DriversTeams Platform.

    3. Only use the DriversTeams Platform as authorized by these Terms or another agreement with us:

      1. You may only use another Member’s personal information as necessary to facilitate a transaction using the DriversTeams Platform as authorized by these Terms.

      2. You may use the Content made available through the DriversTeams Platform solely as necessary to enable your use of the DriversTeams Platform as an Event Host or Service Provider.

      3. Do not use Content unless you have permission from the Content owner or the use is authorized by us in these Terms or another agreement you have with us.

      4. Do not engage in practices intended to manipulate our search algorithm.

      5. Do not use, copy, display, mirror or frame the DriversTeams Platform, any Content, any DriversTeams branding, or any page layout or design without our consent.

    4. Honor your legal obligations:

      1. Understand and follow the laws that apply to you, including privacy, data protection, and export laws.

      2. If you provide us with someone else’s personal information, you: (i) must do so in compliance with applicable law, (ii) must be authorized to do so, and (iii) authorize us to process that information under our Privacy policy.

      3. Do not use the name, logo, branding, or trademarks of DriversTeams or others without permission.

      4. Do not use or register any domain name, social media handle, trade name, trademark, branding, logo, or other source identifier that may be confused with DriversTeams branding.

  2. Reporting Violations. If you believe that a Member, Listings, or Content, poses an imminent risk of harm to a person or property, you should immediately contact local authorities before contacting DriversTeams. In addition, if you believe that a Employers profile, Listing, or Content, has violated our Terms, you should report your concerns to DriversTeams. If you reported an issue to local authorities, DriversTeams might request a copy of that report. Except as required by law, you agree that we are not obligated to take action in response to any report.

14. Termination, Suspension, and Other Measures.

  1. Term. The agreement between you and DriversTeams reflected by these Terms is effective when you access the DriversTeams Platform (i. e. create an account and unconditionally accept these Terms in the manner specified on DriversTeams Platform) and remains in effect until either you or DriversTeams terminates the agreement in accordance with these Terms.

  2. Termination. You may terminate this agreement (Terms) at any time by sending us an email or by deleting your account. DriversTeams may terminate this agreement and your account for a reasonable cause (e. g., breach of these Terms) by giving you 30 days’ notice via email or using any other contact information you have provided for your account. DriversTeams may also terminate this agreement (Terms) immediately and without notice and stop providing access to the DriversTeams Platform if you breach these Terms, violate our Policies, violate applicable laws, or we reasonably believe termination is necessary to protect DriversTeams, its Members, or third parties. Terminating this agreement (Terms) on any grounds will prohibit further use of the DriversTeams Platform. If your account has been inactive for more than two years, we may terminate your account without prior notice.

  3. Member Violations. If (i) you breach these Terms, (ii) you violate applicable laws, regulations, or third-party rights, or (iii) DriversTeams believes it is reasonably necessary to protect DriversTeams, its Members, or third parties; DriversTeams may, with or without prior notice (i) suspend or limit your access to or use of the DriversTeams Platform and/or your account; (ii) suspend or remove your individual booking link and/or Listings, Reviews, or other Content.

  4. Legal Mandates. DriversTeams may take any action it determines is reasonably necessary to comply with applicable law, or the order or request of a court, law enforcement, or other administrative agency or governmental body, including the measures described above in Section 14.3.

  5. Effect of Termination. If you terminate your DriversTeams account, you will have 10 (ten) business days to extract your booking information from the DriversTeams Platform. After this deadline, all data stored by DriversTeams Platform may be permanently deleted. When this agreement has been terminated, you are not entitled to a restoration of your account or any of your Content. If your access to or use of the DriversTeams Platform has been limited, or your DriversTeams account has been suspended, or this agreement has been terminated by us, you may not register a new account, as well as access or use the DriversTeams Platform through an account of another Member.

  6. Survival. Parts of these Terms that by their nature survive termination, will survive termination of this agreement, including Sections 2 through 25.

15. Modification. 

  1. When we propose changes to these Terms, we will post the revised Terms on the DriversTeams Platform and update the “Date of entry into force” date at the top of these Terms. We will explicitly ask you to accept the revised Terms.

  2. We will notify you of the proposed changes by email at least thirty (30) days before the date they become effective. Such notice will also inform you about your right to reject the proposed changes, the timeframe to do so, and your right to terminate the agreement before the effective date of the proposed changes as provided in these Terms. In case of (i) non-material changes to these Terms which do not affect its essential provisions, in particular, provisions defining the nature and scope of the services provided by DriversTeams, or (ii) changes that are required by law, a legally binding court decision, or binding order of a competent authority, or (iii) changes that could affect the rights of the consumers, your continued use of the DriversTeams Platform after the effective date of the proposed changes will constitute acceptance of the revised Terms.

16. DriversTeams's role.

  1. We offer a platform that enables Members to publish, offer, search for, Employers or Employeer. While we work hard to ensure our Members have great experiences, we do not and cannot control the conduct of Employers and Employeer. You acknowledge that DriversTeams has the right, but does not have any obligation, to monitor the use of the DriversTeams Platform and verify information provided by our Members. For example, we may review, disable access to, remove, or edit Content to: (i) operate, secure and improve the DriversTeams Platform (including for fraud prevention, risk assessment, investigation and customer support purposes); (ii) ensure Members’ compliance with these Terms; (iii) comply with applicable law or the order or requirement of a court, law enforcement or other administrative agency or governmental body; (iv) address Content that we determine is harmful or objectionable; (v) take actions set out in these Terms; and (vi) maintain and enforce any quality or eligibi eligibility criteria, including by removing Listings that do not meet quality and eligibility criteria. Members acknowledge and agree that DriversTeams administers its Terms, including decisions about whether and how to apply them to a particular situation, at its sole discretion. Members agree to cooperate with and assist DriversTeams in good faith, and provide DriversTeams with such information and take such actions as may be reasonably requested by DriversTeams concerning any investigation undertaken by DriversTeams regarding the use or abuse of the DriversTeams Platform.

  2. DriversTeams is not and does not become a party to other participants in any contractual relationship between the Members. DriversTeams is not acting as an agent for any Member.

  3. DriversTeams will (a) make the DriversTeams Platform available to a Member under these Terms, (b) provide applicable standard support for the DriversTeams Platform at no additional charge, and/or upgraded support (for an additional charge, if applicable), (c) use commercially reasonable efforts to make the DriversTeams Platform available 24 hours a day, 7 days a week, except for: (i) planned downtime, and (ii) any unavailability caused by circumstances beyond DriversTeams’s reasonable control, including, for example, an act of God, the act of government, flood, fire, earthquake, civil unrest, the act of terror, strike or other labor problem, Internet Employers failure or delay, or denial of service attack. DriversTeams shall not be liable if, through no fault of DriversTeams, the DriversTeams Platform is unavailable, cannot be accessed, etc.

17. Member Accounts.

  1. You must register an account to access and use many features of the DriversTeams Platform. You must provide accurate, current, and complete information during registration and keep your account information up-to-date. DriversTeams reserves the right to request clarification of information or to delete an account/information if DriversTeams founds that the information provided is false. You may not register more than one account or transfer your account to someone else. You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party. You are responsible and liable for activities conducted through your account and must immediately notify DriversTeams if you suspect that your credentials have been lost, or stolen, or your account is otherwise compromised. If and as permitted by applicable law, we may, but have no obligation to (i) ask you to provide identification or other information, (ii) undertake checks designed to help verify your identity or background, (iii) screen you against third-party databases or other sources and request reports from Employers, and (iv) obtain reports from public records of criminal convictions or their local equivalents.

  2. If a Member has designated users and authorized them, such users will be deemed authorized to act on behalf of the Member when using the account. DriversTeams is not responsible for and shall have no liability for verifying the validity of authorization of any user. However, DriversTeams may, at its discretion, request additional information or proof of the person’s credentials. If DriversTeams is not certain if a user has been granted authorisation, DriversTeams may, in its sole discretion, prevent such user from accessing the DriversTeams Platform.

18. Disclaimer and Warranties. 

  1. We provide the DriversTeams Platform and all Content “as is” without warranty of any kind, and we disclaim all warranties, whether express or implied. For example: (i) we do not endorse or warrant the existence, conduct, performance, safety, quality, legality or suitability of any Employer, Employeer, Listing or a third party; (ii) we do not warrant the performance or non-interruption of the DriversTeams Platform; and (iii) we do not warrant that verification, identity or background checks conducted on Members or Services (if any) will identify past misconduct or prevent future misconduct. Any references to a Member or Service being “verified” (or similar language) indicate only that the Member or DriversTeams has completed a relevant verification or identification process and nothing else. The disclaimers in these Terms apply to the maximum extent permitted by law. If you have statutory rights or warranties we cannot disclaim, the duration of any such statutorily required rights or warranties, will be limited to the maximum extent permitted by law.

  2. We are not responsible for outages or disruptions of internet and telecommunications infrastructure, which are beyond our control and can lead to interruptions in the availability of the DriversTeams Platform. DriversTeams may, temporarily and under consideration of the Members’ legitimate interests (e.g. by providing prior notice), restrict the availability of the DriversTeams Platform or certain features thereof, if this is necessary within capacity limits, the security or integrity of our servers, or carry out maintenance measures that ensure the proper or improved functioning of the DriversTeams Platform.

19. Limitations on Liability. 

  1. Neither DriversTeams (including its affiliates and personnel) nor any other party involved in creation, production, or delivery of the DriversTeams Platform or any Content will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Terms, (ii) the use of or inability to use the DriversTeams Platform or any Content, (iii) any communications, interactions or meetings you may have with someone you interact or meet with through, or as a result of, your use of the DriversTeams Platform, or (iv) publishing or employment of a Service, including the provision or use of Services, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not DriversTeams has been informed of the possibility of such damage, even if a limited remedy set out in these Terms is found to have failed of its essential purpose.

  2. These limitations of liability and damages are fundamental elements of the agreement between you and DriversTeams. If applicable laws, including but not limited to consumer protection laws, do not allow the limitations of liability set out in these Terms, the limitations mentioned above may not apply to you.

20. Indemnification. 

  1. To the maximum extent permitted by applicable law, you agree to release, defend (at DriversTeams’s option), indemnify, and hold DriversTeams (including other affiliates, and their personnel) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (i) your breach of these Terms (including any supplemental or additional terms that apply to a product or feature) or our other policies, (ii) your improper use of the DriversTeams Platform, (iii) your interaction with any Member, user of Service, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such use, (iv) your failure, or our failure at your direction, to accurately report, collect or remit Taxes, or (v) your breach of any laws, regulations or third party rights such as intellectual property or privacy rights.

21. United States Governing Law.

  1. If you reside or have your place of establishment in the United States, these Terms and any relationship between DriversTeams and Member will be interpreted under the laws of the Republic of Lithuania, without regard to conflict-of-law provisions.

22. United States Dispute Resolution and Arbitration Agreement. 

  1. Consumer disputes. DriversTeams is committed to participating in a consumer-friendly dispute resolution process. As a consumer, if you disagree with any decisions made by DriversTeams, you can complain directly to DriversTeams. In case you disagree with DriversTeams's response to the written complaint, you (natural person, consumer) may submit a request/complaint regarding the DriversTeams’s decisions/actions to the State Consumer Rights Protection Authority (Vilniaus St. 25, LT-01402 Vilnius, the Republic of Lithuania, e-mail: tarnyba@vvtat.lt, phone: 85 262 67 51, fax. (85) 279 1466, on the website www.vvtat.lt (as well as the territorial units of the State Consumer Rights Protection Service in the districts) - or by filling in the request form on the EGS (European Commission’s online dispute resolution platform) https://ec.europa.eu/odr/.

  2. As a consumer, you may also bring any judicial proceedings relating to these Terms before the competent court of your place of residence or the competent court of DriversTeams’s place of business. If DriversTeams wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident.

  3. Business client disputes. All disputes arising out of the performance of the Terms and other agreements shall be resolved by negotiation between the parties. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania, with jurisdiction to be determined according to the address of the registered office of DriversTeams‘s contracting entity.

23. Governing Law and Venue in Europe. 

  1. If you reside or have your place of establishment in the European Union, these Terms and any relationship between DriversTeams and Member will be interpreted under the laws of the Republic of Lithuania, without regard to conflict-of-law provisions.  

24. Dispute Resolution in Europe.

  1. Application. This section of the Terms only applies to you if your country of residence or establishment is in the European Union.

  2. Consumer disputes. DriversTeams is committed to participating in a consumer-friendly dispute resolution process. As a consumer, if you disagree with any decisions made by DriversTeams, you can complain directly to DriversTeams. In case you disagree with DriversTeams's response to the written complaint, you (natural person, consumer) may submit a request/complaint regarding the DriversTeams’s decisions/actions to the State Consumer Rights Protection Authority (Vilniaus St. 25, LT-01402 Vilnius, the Republic of Lithuania, e-mail: tarnyba@vvtat.lt, phone: 85 262 67 51, fax. (85) 279 1466, on the website www.vvtat.lt (as well as the territorial units of the State Consumer Rights Protection Service in the districts) - or by filling in the request form on the EGS (European Commission’s online dispute resolution platform) https://ec.europa.eu/odr/.

  3. As a consumer, you may also bring any judicial proceedings relating to these Terms before the competent court of your place of residence or the competent court of DriversTeams’s place of business. If DriversTeams wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident.

  4. Business client disputes. All disputes arising out of the performance of the Terms and other agreements shall be resolved by negotiation between the parties. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania, with jurisdiction to be determined according to the address of the registered office of DriversTeams‘s contracting entity.

25. Contracting Entities.

  2. If you change your country of residence or establishment, the DriversTeams company you contract with, and the applicable version of the Terms will be determined by your new country of residence or establishment from the date on which your country of residence or establishment changes.

26. Miscellaneous.

  1. Member liability. All Members shall be fully liable for all damages incurred by DriversTeams, including all direct and indirect damages, loss of income/profits etc., caused by its illegal or infringing acts against DriversTeams. In the event that the law limits the amount and/or scope of damages to be indemnified, Member shall reimburse DriversTeams for the maximum amount of damages permitted by law.

  2. Other Terms Incorporated by Reference. Our Privacy Policy and other supplemental policies and terms linked to in these Terms apply to your use of the DriversTeams Platform, are incorporated by reference, and form part of your agreement with DriversTeams.

  3. Interpreting these Terms. Except as they may be supplemented by additional terms, conditions, policies, guidelines, standards, and in-product disclosures, these Terms (including those items incorporated by reference) constitute the entire agreement between you and DriversTeams pertaining to your access to or use of the DriversTeams Platform and supersede any and all prior oral or written understandings or agreements between you and DriversTeams . These Terms do not and are not intended to confer any rights or remedies upon anyone other than you and DriversTeams. If any provision of these Terms is held to be invalid or unenforceable, except as otherwise indicated in Section 21 above, such provision will be struck and will not affect the validity and enforceability of the remaining provisions. Where the word “will” is used in these Terms it connotes an obligation with the same meaning as “shall.”

  4. No Waiver. DriversTeams’s failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise permitted under law.

  5. Assignment. You may not assign, transfer or delegate this agreement or your rights and obligations hereunder without DriversTeams’s prior written consent. DriversTeams may without restriction assign, transfer or delegate this agreement and any rights and obligations hereunder, at its sole discretion, with 30 days’ prior notice, provided that this does not reduce the scope of the guarantees offered to the Employer (natural person, consumer).

  6. Notice. Unless specified otherwise, any notices or other communications to Members permitted or required under this agreement, will be provided electronically and given by DriversTeams via email, DriversTeams Platform notification, messaging service (including SMS), or any other contact method we enable and you provide.

  7. Third-Party Services. The DriversTeams Platform may contain links to third-party websites, applications, services, or resources (“Third-Party Services”) that are subject to different terms and privacy practices. DriversTeams is not responsible or liable for any aspect of such Third-Party Services and links to such Third-Party Services are not an endorsement.

  8. Google Terms. Some areas of the DriversTeams Platform may implement Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth is subject to the Google Maps/Google Earth Additional Terms of Service.

  9. Apple Terms. If you access or download our application from the Apple App Store, you agree to Apple’s Licensed Application End User License Agreement.

  10. DriversTeams Platform Content. Content made available through the DriversTeams Platform may be protected by copyright, trademark, and/or other laws of the United States and other countries. You acknowledge that all intellectual property rights for that Content are the exclusive property of DriversTeams and/or its licensors and agree that you will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices. You may not use, copy, adapt, modify, prepare derivative works of, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast or otherwise exploit any Content accessed through the DriversTeams Platform except to the extent you are the legal owner of that Content or as expressly permitted in these Terms. Subject to your compliance with these Terms, DriversTeams grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to (i) download and use the Application on your personal device(s); and (ii) access and view the Content made available on or through the DriversTeams Platform and accessible to you, solely for your personal and non-commercial use.

  11. Force Majeure. DriversTeams shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, internet outages, Denial of Service attacks, pandemics, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials.

  12. Emails and SMS. You will receive administrative communications from DriversTeams using the email address or other contact information you provide for your DriversTeams account. You may also receive promotional emails from DriversTeams. No fee is charged for these promotional emails, but third-party data rates could apply. Please note that you will not be able to take advantage of certain promotions if you disable certain communication settings or do not have a DriversTeams account. For contractual purposes, you agree that all agreements, notices, disclosures and other communications that we provide you electronically, satisfy any legal requirement that such communications be in writing, unless mandatory applicable laws specifically require a different form of communication.

DriversTeams PRIVACY POLICY

DriversTeams is building a community of our Members based on trust. A fundamental part of earning that trust means being clear about how we use your information and protect your human right to privacy.

This Privacy Policy describes how DriversTeams, Inc. and its affiliates (“we,” “us,” or “DriversTeams”), process personal information that we collect through the DriversTeams Platform. Depending on where you live and what you are doing on the DriversTeams Platform, the supplemental privacy pages listed below may apply to you. Please follow the links and review the supplemental information provided there with information about how we process personal information for those regions and services.

  1. DEFINITIONS

    1. Undefined terms in this Privacy Policy have the same definition as in our Terms of Service (“Terms”).
  2. PERSONAL INFORMATION WE COLLECT

    1. Information Needed to Use the DriversTeams Platform. We collect personal information about you when you use the DriversTeams Platform. Without it, we may not be able to provide you with all services requested. This information includes:
    2. Contact information, account, profile information. Such as your first name, last name, phone number, postal address, email address, profile photo, and event details, some of which will depend on the features you use.
      Identity verification and payment information. Such as your ID number or other verification information, bank account or payment account information.
    3. Information You Choose to Give Us. You can choose to provide us with additional personal information. This information may include:
      1. Additional profile information. Such as gender, preferred language(s), city, and personal description.
      2. Address book contact information. Address book contacts you import or enter manually.
      3. Other information. Such as when you fill in a form, add information to your account, respond to surveys, post to community forums, participate in promotions, communicate with our customer care team and other Members, or share your experience with us.
      4. Information Automatically Collected by Using the DriversTeams Platform. When you use the DriversTeams Platform, we automatically collect personal information. This information may include:
        1. Geo-location information. Such as precise or approximate location determined from your IP address or mobile device’s GPS depending on your device settings. We may also collect this information when you’re not using the app if you enable this through your settings or device permissions.
        2. Usage information. Such as the pages or content you view, searches for Listings, and other actions on the DriversTeams Platform.
          Log data and device Information. Such as details about how you’ve used the DriversTeams Platform (including if you clicked on links to third party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, cookie data, and the pages you’ve viewed or engaged with before or after using the DriversTeams Platform. We may collect this information even if you haven’t created a DriversTeams account or logged in.
        3. Cookies and similar technologies as described in our Cookie Policy.
        4. Payment transaction information. Such as payment instrument used, date and time, payment amount, payment instrument expiration date and billing postcode, IBAN information, your address and other related transaction details.
      5. Personal Information We Collect from Third Parties. We collect personal information from other sources, such as:
        1. Third-party services. If you link, connect, or login to the DriversTeams Platform with a third party service (e.g. Google, Facebook), you direct the service to send us information such as your registration, friends list, and profile information as controlled by that service or as authorized by you via your privacy settings at that service.
          Background information. For Members in the United States, to the extent permitted by applicable laws, we may obtain reports from public records of criminal convictions or sex offender registrations.
        2. Invitations and account management. Organizations that use DriversTeams Platform may submit personal information to facilitate account management and invitations to use our products.
        3. Referrals and co-event hosts. If you are invited to the DriversTeams Platform as a co-event host, the person who invited you can submit personal information about you such as your email address or other contact information.
        4. Other Sources. To the extent permitted by applicable law, we may receive additional information about you, such as references, demographic data or information to help detect fraud and safety issues from third party service providers and/or partners, and combine it with information we have about you. 
  3. HOW WE USE INFORMATION WE COLLECT 

    1. Provide, improve, and develop the DriversTeams Platform. We use personal information to:
      1. enable you to access the DriversTeams Platform and make payments,
      2. enable you to communicate with other Members,
      3. perform analytics, debug and conduct research,
      4. send you messages, updates, security alerts, and account notifications,
      5. if you provide us with your contacts’ information such as your friends, partners, we may process this information: (i) to facilitate your referral invitations, (ii) to share your information, (iii) for fraud detection and prevention, and (iv) to facilitate your requests or for any other purpose you authorize,
      6. personalize and customize your experience based on your interactions with the DriversTeams Platform, your search, your profile information and preferences, and other content you submit.
    2. Create and maintain a trusted and safer environment. We use personal information to:
      1. detect and prevent fraud, spam, abuse, security and safety incidents, and other harmful activity,
      2. study and combat discrimination,
      3. conduct security investigations and risk assessments,
      4. verify or authenticate information provided by you,
      5. conduct checks against databases and other information sources, including background or police checks,
      6. resolve disputes with our Members,
      7. enforce our agreements with third parties,
      8. comply with law, respond to legal requests, prevent harm and protect our rights,
        enforce our Terms and other policies, and
      9. in connection with the activities above, we may conduct profiling based on your interactions with the DriversTeams Platform, your profile information and other content you submit to DriversTeams, and information obtained from third parties. In limited cases, automated processes could restrict or suspend access to the DriversTeams Platform if such processes detect activity that we think poses a safety or other risk to DriversTeams, our community, or third parties.     3. Provide, personalize, measure, and improve our advertising and marketing. We may use personal information to:
      1. send you promotional messages, marketing, advertising, and other information based on your preferences and social media advertising through social media platforms,
      2. personalize, measure, and improve our advertising,
      3. administer referral programs, rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by DriversTeams or its third-party partners,
      4. analyze characteristics and preferences to send you promotional messages, marketing, advertising and other information that we think might be of interest to you, and
      5. invite you to events and relevant opportunities.
    4. Provide payment services. Personal information is used to enable or authorize the use of payment services:
      1. detect and prevent money laundering, fraud, abuse, security incidents,
        conduct security investigations and risk assessments,
      2. comply with legal obligations (such as anti-money laundering regulations),
      3. enforce the payment terms pand other payment policies,
      4. improve the payment services.
  4. SHARING AND DISCLOSURE

    1. Sharing with your consent or at your direction.
    2. Where you provide consent, we share your information as described at the time of consent, such as when authorizing a third-party application or website to access your DriversTeams account or participating in promotional activities by DriversTeams partners or third parties.
      Where permissible with applicable law, we may use certain information about you, such as your email address, de-identify it, and share it with social media platforms, to generate leads, drive traffic to DriversTeams or otherwise promote our products and services.
    3. Sharing between Members. To help facilitate interactions between Members, we may need to share certain information such as:
      1. When a request is made or dispute is submitted, certain information may be shared between Members, including profile, name, cancellation history, review information, age of the event hosts (unless prohibited by applicable law), dispute outcome (when applicable) and other information you choose to share and submit.
    4. Information you publish on the DriversTeams platform, Listings, and other public Information. We may display parts of your public profile, Listings and other Content you make available to the public like Listing details on third-party sites, platforms and apps. Information you share publicly on the DriversTeams Platform may be indexed through third-party search engines. 
    5. Complying with law, responding to legal requests, preventing harm and protecting our rights. We may disclose your information to courts, law enforcement, governmental or public authorities, tax authorities, or authorized third parties, if and to the extent we are required or permitted to do so by law or where disclosure is reasonably necessary: (i) to comply with our legal obligations, (ii) to comply with a valid legal request or to respond to claims asserted against DriversTeams, (iii) to respond to a valid legal request relating to a criminal investigation to address alleged or suspected illegal activity, or to respond to or address any other activity that may expose us, you, or any other of our users to legal or regulatory liability, (iv) to enforce and administer our agreements with Members, or (v) to protect the rights, property or personal safety of DriversTeams, its employees, its Members, or members of the public. Where appropriate, we may notify Members about legal requests unless: (i) providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law, or (ii) we believe that providing notice would be futile, ineffective, create a risk of injury or bodily harm to an individual or group, or create or increase a risk of fraud upon or harm to DriversTeams, our Members, or expose DriversTeams to a claim of obstruction of justice. 
    6. Third-party service providers. We share personal information with affiliated and unaffiliated service providers to help us run our business, including service providers that help us: (i) verify your identity or authenticate your identification documents, (ii) check information against public databases, (iii) conduct background or police checks, fraud prevention, and risk assessment, (iv) perform product development, maintenance and debugging, (v) allow the provision of the DriversTeams Platform through third-party platforms and software tools (e.g. through the integration with our APIs), (vi) provide customer service, advertising, or payments services. These providers are contractually bound to protect your personal information and have access to your personal information to perform these tasks.
    7. Business transfers. If DriversTeams undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer or share some or all of our assets, including your information in connection with such transaction or in contemplation of such transaction (e.g., due diligence). In this event, we will notify you before your personal information is transferred and becomes subject to a different privacy policy.
    8. Corporate affiliates. To support us in providing, integrating, promoting and improving the DriversTeams Platform, we may share personal information within our corporate family of companies that are related by common ownership or control. 
  5. OTHER IMPORTANT INFORMATION

    1. Analyzing your communications. We may review, scan, or analyze your communications on the DriversTeams Platform for reasons outlined in this privacy policy,  including fraud prevention, risk assessment, regulatory compliance, investigation, product development, research, analytics, enforcing our Terms, and customer support purposes. We use automated methods where reasonably possible. Occasionally we may need to manually review communications, such as for fraud investigations and customer support, or to assess and improve the functionality of these automated tools. We will not review, scan, or analyze your messaging communications to send third-party marketing messages to you and we will not sell reviews or analyses of these communications.
    2. Linking third-party accounts. You can link your DriversTeams account with certain third-party services like social networks. Your contacts on these third-party services are referred to as “Friends.” When you direct the data sharing by creating this link:
      1. some of the information provided to us from linking accounts may be published on your public profile, including Listings,
      2. a link to your public profile on that third-party service may be included in your public profile, including Listings,
      3. information you provide to us from the linking of your accounts may be stored, processed and transmitted for fraud prevention and risk assessment purposes, and
        publication and display of information that you provide to the DriversTeams Platform through this linkage is subject to your settings and authorizations on the third-party service.
    3. Third-party partners & integrations. Parts of DriversTeams Platform may link to third-party services, not owned or controlled by DriversTeams, such as Google Maps/Earth. Use of these services is subject to the privacy policies of those providers. DriversTeams does not own or control these third parties and when you interact with them you are providing your information to them.
  6. YOUR RIGHTS

    1. You can exercise any of the rights described in this section consistent with applicable law. See here for information on data subject rights requests and how to submit a request. Please note that we may ask you to verify your identity and request before taking further action on your request.
    2. Managing Your Information. You can access and update some of your personal information through your Account settings.
    3. Data access and portability. In some jurisdictions, applicable law may entitle you to request certain copies of your personal information or information about how we handle your personal information, request copies of personal information that you have provided to us in a structured, commonly used, and machine-readable format, and/or request that we transmit this information to another service provider (where technically feasible).
    4. Data erasure. In certain jurisdictions, you can request that your personal information be deleted. Request to delete information should be submitted to DriversTeams via email support@DriversTeams.com and the information will be deleted within 3 business days. Please note that if you request the erasure of your personal information:
      1. We may retain your personal information as necessary for our legitimate business interests, such as prevention of money laundering, fraud detection and prevention, and enhancing safety. For example, if we suspend a DriversTeams account for fraud or safety reasons, we may retain information from that account to prevent that Member from opening a new account in the future.
      2. We may retain and use your personal information to the extent necessary to comply with our legal obligations. For example, we may keep information for tax, legal reporting and auditing obligations.
      3. Information you have shared with others (e.g., reviews, forum postings) will continue to be publicly visible on DriversTeams, even after your account is cancelled. However, attribution of such information to you will be removed. Some copies of your information (e.g., log records) will remain in our database, but are disassociated from personal identifiers.
      4. Because we take measures to protect data from accidental or malicious loss and destruction, residual copies of your personal information may not be removed from our backup systems for a limited period of time.
  7. SECURITY 

    1. While no organization can guarantee perfect security, we are continuously implementing and updating administrative, technical, and physical security measures to help protect your information against unauthorized access, loss, destruction, or alteration.
  8. CHANGES TO THIS PRIVACY POLICY

    1. We reserve the right to modify this privacy policy at any time in accordance with applicable law. If we do so, we will post the revised privacy policy and update the “Last Updated” date at the top. In case of material changes, we will also provide you with notice of the modification by email at least thirty (30) days before the effective date. If you disagree with the revised privacy policy, you can cancel your account. If you do not cancel your account before the date the revised privacy policy becomes effective, your continued access to or use of the DriversTeams Platform will be subject to the revised privacy policy.

DriversTeams COOKIE POLICY

DriversTeams uses cookies, mobile identifiers, tracking URLs, log data and similar technologies to help provide, protect, and improve the DriversTeams Platform. This Cookie Policy (“Policy”) supplements  our Privacy Policy and explains how and why we use these technologies and the choices you have.

Why DriversTeams uses these technologies

We use these technologies for a number of purposes, such as:

  • to enable you to use and access the DriversTeams Platform,

  • to enable, facilitate and streamline the functioning of and your access to the DriversTeams Platform,

  • to better understand how you navigate through and interact with the DriversTeams Platform and to improve it,

  • to serve you tailored advertising, 

  • to show you content (e.g., advertisements) that is more relevant to you,

  • to monitor and analyze the performance, operation, and effectiveness of the DriversTeams Platform and DriversTeams advertisements,

  • to enforce legal agreements that govern use of the DriversTeams Platform,

  • for fraud detection and prevention, trust and safety, and investigations,

  • for purposes of our own customer support, analytics, research, product development, and regulatory compliance.

Cookies

When you visit the DriversTeams Platform we may place cookies on your device. Cookies are small text files that websites send to your computer or other Internet-connected device to uniquely identify your browser or to store information or settings in your browser. Cookies allow us to recognize you when you return. They also help us provide a customized experience and can enable us to detect certain kinds of fraud. In many cases the information we collect using cookies and other tools is only used in a non-identifiable manner without reference to personal information. For example, we may use information we collect to better understand website traffic patterns and to optimize our website experience. In some cases we associate the information we collect using cookies and other technology with your personal information. Our business partners may also use these tracking technologies on the DriversTeams or engage others to track your behavior on our behalf.

There are two types of cookies used on the DriversTeams Platform: (1) “session cookies” and (2) “persistent cookies.” Session cookies normally expire when you close your browser, while persistent cookies remain on your device after you close your browser, and can be used again the next time you access the DriversTeams Platform.

In many cases you can manage cookie preferences and opt-out of having cookies and other data collection technologies used by adjusting the settings on your browser. All browsers are different so visit the “help” section of your browser when to learn about cookie preferences and other privacy settings that may be available. Please note that if you choose to remove or reject cookies or clear local storage this could affect the features, availability, and functionality of the DriversTeams Platform.

Pixel tags, web beacons, and trackers

Pixel tags, web beacons, and tracking urls are tiny graphic images and/or small blocks of code placed on website pages, ads, or in our emails that allow us to determine whether you performed a specific action. When you access these pages, or when you open an email, let us know you have accessed the web page or opened the email. These tools help us measure response to our communications and improve our web pages and promotions.

Server logs and other technologies

We collect many different types of information from server logs and other technologies. For example, we collect information about the device you use to access the DriversTeams Platform, your operating system type, browser type, domain, and other system settings, as well as the language your system uses and the country and time zone where your device is located. Our server logs also record the IP address of the device you use to connect to the Internet. An IP address is a unique identifier that devices require to identify and communicate with each other on the Internet. We may also collect information about the website you were visiting before you came to the DriversTeams Platform and the website you visit after you leave the DriversTeams Platform. These tools help us improve user experience and deliver our services.

Device information

We may use device-related information to authenticate users. For example, we may use your IP address, browser information, or other data provided by your browser or device to identify the device being used to access our platform. We may also use these device-related techniques for associating you with different devices that you may use to access our content including for fraud-protection purposes and to better target advertising.

Third parties

Third parties, including Facebook, place technologies such as pixels and SDKs on the DriversTeams Platform. These technologies (1) help us analyze how you use the DriversTeams Platform, such as by noting the third party services from which you arrived, (2) market and advertise DriversTeams services to you on the DriversTeams Platform and third party websites, (3) help us detect or prevent fraud or conduct risk assessments, and (4) collect information about your activities on the DriversTeams Platform, other sites, and/or the ads you have clicked on. For example, to help us better understand how people use the DriversTeams Platform, we work with a number of analytics partners, including Google Analytics. To prevent Google Analytics from using your information for analytics, you may install the Google Analytics Opt-Out Browser by clicking here.

Third parties, including Facebook, may also use such tracking technologies to collect or receive information from the DriversTeams Platform and elsewhere and use that information to serve ads that they believe are most likely to be of interest to you and measure the effectiveness of their ads both on the DriversTeams Platform and on other websites and online services. Targeting and advertising cookies we use may include Google, and other advertising networks and services we use from time to time. For more information about targeting and advertising cookies and how you can opt out, you can visit the Network Advertising Initiative’s opt-out page, the Digital Advertising Alliance’s opt-out page, or http://youronlinechoices.eu. To opt out of Google Analytics for display advertising or customize Google display network ads, you can visit the Google Ads Settings page. To the extent advertising technology is integrated into the DriversTeams Platform and you opt-out of tailored advertising, you may still receive advertising content. In that case, the advertising content will just not be tailored to your interests. Also, we do not control any of these opt-out links and are not responsible for the availability or accuracy of these mechanisms. Users can opt-out of the collection and use of information for ad targeting by updating their Facebook account ad settings and by contacting support@DriversTeams.com with a description of your request and validation information.

Third party social plugins

The DriversTeams Platform may use social plugins provided and operated by third parties, such as Facebook’s Like Button or Reviews. As a result of this, you may send to the third party the information that you are viewing on a certain part of the DriversTeams Platform. If you are not logged into your account with the third party, then the third party may not know your identity. If you are logged in to your account with the third party, then the third party may be able to link information or actions about your interactions with the DriversTeams Platform to your account with them. Please refer to the third party’s privacy policies to learn more about its data practices.

Your choices

Most browsers automatically accept cookies, but you can modify your browser setting to decline cookies by visiting the Help portion of your browser’s toolbar. While you may disable cookies through your browser settings, the DriversTeams Platform currently does not respond to a “Do Not Track” signal in the HTTP header from your browser or mobile application due to lack of standardization regarding how that signal should be interpreted.

If you choose to decline cookies, some parts of the DriversTeams Platform may not work as intended or may not work at all.
